These Terms of Service (“Terms”) are a legal agreement between you and Vitamin Z, doing business as AI Pixel Pilot (“AI Pixel Pilot,” “we,” “us,” or “our”). By purchasing, accessing, or using aipixelpilot.com or its services, you agree to these Terms and our Privacy, Refund and Cancellation, and Cookie Policies.
1. Eligibility and Accounts
You must be at least 18 years old and able to enter a binding contract. You must provide accurate information, protect your login credentials, and promptly notify us of unauthorized access. You are responsible for activity occurring through your account. Accounts may not be sold, shared publicly, or transferred without written permission.
2. Free Account, Subscription, and Automatic Renewal
New customers may create a free account with 50 credits and no payment card. When a customer chooses to download, Stripe displays the monthly subscription price before payment. The subscription includes 1,000 credits after each successful monthly payment and renews monthly using the payment method on file until canceled. Taxes may be added where required. Existing customers remain subject to the price and credit allowance shown when they subscribed unless they agree to a change.
You authorize our payment processor to charge the recurring subscription amount until cancellation. You may cancel future renewals through the Stripe billing portal when available or by using the cancellation method provided with your subscription. Cancellation stops future renewal charges but does not automatically reverse a completed charge.
3. Credits
Credits are a limited license to use eligible AI features. They are not money, stored value, property, or a gift card; have no cash value; cannot be transferred or resold; and may be used only within AI Pixel Pilot. Tool costs are displayed inside the customer account or editor and may vary by feature.
Credits are deducted only when an eligible AI operation succeeds. If the operation fails before completion, the reserved credits are ordinarily returned automatically. We may correct balances affected by errors, fraud, chargebacks, duplicate grants, or misuse. Rules concerning the expiration or continued availability of subscription credits will be clearly disclosed before paid checkout is enabled.
4. Your Photos and Content
You retain whatever rights you lawfully hold in content you submit. You grant AI Pixel Pilot and its service providers a limited, worldwide license to host, copy, transmit, modify, and process that content only as reasonably necessary to provide, secure, support, and improve the requested Service and comply with law.
You represent that you own the content or have all permissions needed to upload and process it, including permission from identifiable people where required. You are responsible for deciding whether a photo is appropriate to submit and for downloading and safeguarding completed work.
5. Acceptable Use
You may not use the Service to violate law or another person’s rights; impersonate, defraud, harass, threaten, exploit, or harm anyone; create unlawful sexual content or sexual content involving minors; process intimate imagery without consent; infringe privacy, publicity, copyright, trademark, or other rights; distribute malware; bypass security, credit, or access controls; reverse engineer protected systems; overload the Service; or use automated access without written permission.
We may block content, suspend processing, preserve evidence, report conduct, or terminate access when we reasonably believe activity is illegal, unsafe, abusive, fraudulent, or inconsistent with these Terms.
6. AI Results and Editing Limitations
AI-generated or AI-edited results may be inaccurate, unexpected, distorted, incomplete, offensive, or different from your instructions. Results may alter faces, text, logos, colors, objects, backgrounds, proportions, or other details. You must review every result before relying on, publishing, printing, selling, or sharing it.
We do not guarantee that a result will preserve identity, be unique, be free of third-party similarities, qualify for intellectual-property protection, or be suitable for legal, medical, safety-critical, identification, evidentiary, or professional use.
7. AI Pixel Pilot Property
The Service, website design, software, branding, interfaces, documentation, and original materials supplied by us are owned by Vitamin Z or its licensors and are protected by law. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
8. Third-Party Services
The Service relies on third parties, including Hostinger, Replicate and model providers, Stripe, and email services. Their services may be interrupted, changed, restricted, or governed by separate terms. We are not responsible for third-party websites or services outside our reasonable control.
9. Availability, Changes, and Termination
We may maintain, update, add, limit, suspend, or discontinue features. We do not promise uninterrupted or error-free operation. We may suspend or terminate an account for nonpayment, chargebacks, security concerns, unlawful conduct, abuse, or material violation of these Terms. You may stop using the Service and cancel future renewal at any time.
10. Refunds
Refunds and cancellations are governed by our Refund and Cancellation Policy, which is incorporated into these Terms.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VITAMIN Z AND AI PIXEL PILOT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY; OR UNAUTHORIZED ALTERATION OR LOSS OF CONTENT. OUR TOTAL LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO AI PIXEL PILOT DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. These limitations do not apply where prohibited by law.
13. Indemnification
To the extent permitted by law, you agree to defend and indemnify Vitamin Z and AI Pixel Pilot from claims, losses, and reasonable expenses arising from your content, your unlawful or unauthorized use, your violation of another person’s rights, or your material breach of these Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Georgia and applicable United States federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to contact support@aipixelpilot.com and allow 30 days for an informal resolution. Any legal action that is not resolved informally shall be brought in a court of competent jurisdiction in Georgia, unless applicable consumer law requires otherwise.
15. General Terms
If a provision is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization or transfer of the business. These Terms and the incorporated policies are the entire agreement concerning the Service.
16. Changes and Contact
We may update these Terms. Material changes will be posted or otherwise communicated, and continued use after the effective date constitutes acceptance where permitted by law.
